1. Confirmation

Signing this contract and payment of 50% deposit as the retainer/booking fee are necessary to confirm the stated wedding services from NCP.

2. Description of Services

This agreement constitutes an order for wedding photography/videography services, and any additional services outlined above in Package. It is agreed to by both parties, NCP and Client, as described above. Client agrees to pay Total Amount by the Final Payment Due By date as defined above. Any additional goods or services not included in this wedding photography contract will be sold at then-current rates. 

3. Client Rights

Regarding the images delivered, as digital files or otherwise, Client’s rights are limited to personal use. Sale, Publication or any Commercial use of videos is not allowed without prior written permission from NCP.

4. Photographer Rights

It is understood that any and all images, whether proofs, digital files, final prints or sample prints, and all rights to them remain the property of the Photographer.

5. Cooperation

The Clients and NCP consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. We recommend that NCP be provided with a helper (usually the best man) who will point out key individuals to be filmed. NCP may also require the assistance of the best man in organizing family groups. The Clients also agree to give NCP sufficient warning of key events at the wedding to give NCP time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having to be filmed. In such cases NCP will use his discretion but cannot be held responsible for a lack cooperation.

6. House Rules.

NCP is limited by the guidelines of the ceremony officiant or the reception site management. For example some ministers insist that no filming is allowed, and others will insist that the videographer shoot from a specific location.The Client agrees to accept the technical results of their imposition on NCP. Negotiation with the officials for moderation of guidelines is the Client's responsibility.

7. Permissions

All permits and permissions required for the Photographer to photograph the event, whether for location, personal release or any other cause, are the responsibility of the Client to obtain.

8. Responsibilities

Nicole Constante will be the sole and exclusive photographer/videographer for the above listed events unless agreed upon in certain circumstances. NCP may bring one assistant/ 2nd shooter. Photographer is responsible for bringing any equipment or assistants necessary to conduct the services outlined in this contract. Clients agree to prevent any other photographers or videographers at the events listed in this contract from interfering with the Photographer’s performance of their duties. This includes wedding guests and other amateur photographers or videographers. Photographer will not be held liable for compromised event coverage due to interference from other parties, including late arrivals by members of the wedding party or their guests. Likewise, Photographer is not responsible for degraded coverage due to environmental issues, such as poor event lighting, space, or backdrops. Client agrees to confirm the event’s date, time, and location no later than 7 days prior to agreed upon date above.

9. Coverage. NCP will provide coverage for the dates, locations and continuous hours specified in this Agreement. Additional travel or coverage hours may be added by agreement on the wedding day and must be paid in full before any photos or products are released to the Client. Client agrees to compensate NCP at the rate of $100 per extra hour of overtime coverage if not included. 

10. Reservation & Reservation Fee

The Amount Due at Signing, as defined above, is a Reservation Fee. Upon receipt the Photographer will reserve the time agreed upon for the Event Date and will not make another reservation for the agreed upon time. For this reason, the Reservation Fee is non-refundable.

11. Limitation of Liability

Although all care will be taken with these photography services and the digital photographs taken, the Photographer limits any liability for loss, injury, death, inability to perform the photography services for any reason, failure to deliver images for any reason or any other types of damages to the return of all payments already paid to the Photographer up to Total Amount defined above.

If NCP is too ill or becomes injured and cannot supply the wedding services specified above the Videographer will try to book a replacement wedding Videographer but will still do the post-processing and editing. However, there is the unlikely possibility that video may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.

12. Feeding the Photographer(s): Meals will be provided to the Photographer(s) at appropriate meal times during the wedding day when there are six or more hours of coverage. Meals are to be provided at the time the Bride & groom are eating. The Caterer may not require that the Photographer(s) should be made to wait until all the guests have eaten or been served before the Photographer is provided food or that the Photographer(s) be required to eat in a separate room. Please discuss these details and meals with your caterer. The Photographer must be able to eat as near to the time as the Bride and Groom eat to ensure that the Photographer(s) can be finished eating before the toasts or any other part of the reception occurs that should be photographed.

13. Photographer's Creative License: Photographer reserves the right to edit and will be the final authority on the images that will be provided to client or offered for sale to the client. Images are edited at the Photographer’s discretion, and delivered images will not include all images shot during the course of the wedding day. The photographer reserves the creative right to edit and release only those images deemed creditable as professional in quality and within the Photographer’s artistic standards. The Photographer is not responsible for subjective interpretations of photography.

14. Model Release

This wedding photography contract serves as a model release. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. The Clients waive the right to inspect any images produces using the images or footage from the events in this contract, and the right to restrict the use of the images or footage from the listed events by the Photographer.

15. Delivery of the final output

The final edited images/video reel will be given via a flash drive delivered to the Client's shipping address 2-3 weeks after the wedding. 

16. Indemnification

Client hereby agrees to indemnify, release, discharge and hold harmless the Photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority of the Photographer from and against any liability or claims arising as a result of any work done related to this agreement. This includes, but is not limited to claims related to the use of the likenesses of anyone captured in the images or any distortion, blurring or alteration that may occur or be produced in the taking, processing or reproduction of the photographs. The Clients acknowledge that they are responsible for ensuring appropriate behavior by their guests, wedding party, and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behavior directed at them, their assistants, or their equipment, Photographer reserves the right to end coverage of the events, retain all fees paid by the Client, and hold no further responsibilities to the Clients. Photographer agrees to notify the Clients of any of the above listed behaviors, and give them an opportunity to correct such behaviors, or remove the offending individuals from the venue prior to ending event coverage

17. Transfer

This agreement cannot be transferred or assigned to any third party by either the Photographer or Client without written consent of both Parties.

18. Entire Agreement

This is the entire agreement between Photographer and Client and supersedes all previous agreements. It cannot be altered without written consent of both Photographer and Client.

19. Execution

Digitally signing this agreement has the same effect as manually signing a paper original.
